If you haven't paid attention, in 2015 there was a move to make touching the ECU illegal via the DMCA act, a copyright violation. That didn't happen. Now it appears the EPA is going in another direction. They seem to claim that any change from production to the ECU is a CAA violation

Sept, 2021 Small Speed shop hit with a big fine for selling new ECUs not approved for production cars going into race cars. The shop was the intermediary selling a product made by someone else. It looks like the ECUs were never intended to be driven on public roads but for production cars being turned into race cars. But the EPA seems to not care. If its a production car, you can't touch the ECU.

The issue isn't any one thing, but the overall trend. It started with the DMCA copyright rules that failed. The VAG scandal might have accelerated this. Now it looks like they are looking closely at small speed shops. And now the CA CARB is going after individuals. It looks like they are becoming more and more serious about enforcement of the CAA.

I recently read that the CA Highway Patrol is going after those with louder than a certain dB rating exhaust and then checking for ECU‘s at the same time

FYI - there is a bill supported by some members of Congress to protect liberties within the U.S.
